The Arizona Motor Vehicle Division classifies a standard DUI as driving a vehicle with a blood alcohol concentration of 0.08%. If you are a commercial truck driver, the legal limit drops to 0.04%.
Additionally, you can be charged with a standard DUI if you are under the age of 21 and operate a vehicle with any percentage blood alcohol concentration.
If you drive with a BAC of 0.15% or higher, you can be charged with extreme DUI. In addition, there is what is called an (A)(1) charge of driving which involves being impaired to the slightest degree.
One other type of DUI that most people are unaware of involves driving under the influence of drugs, including prescription drugs.
The DUI penalties you face depend on the type of DUI conviction you receive. If you refuse to take a Breathalyzer or blood test, the Arizona Motor Vehicle Department will most likely suspend your driver’s license for 12 months.
If this was your second refusal within 84 months, the MVD may suspend your license for 24 months.
A first offense standard DUI may result in 10 days in jail, fines of $1,250, community service and installation of an ignition interlock in every vehicle you drive.
Arizona Extreme DUI Penalties
For a first offense extreme DUI, you may be sentenced to 30 days in jail and assessed fines of at least $2,500.
You will also be required to complete an alcohol or drug screening treatment and education program and install an ignition interlock device on every vehicle you drive.
